If your permanent physical impairment is 35% or more, you can apply to be accepted as a ‘seriously injured worker’ with lifetime benefits and once accepted, you can elect to receive a lump sum settlement in exchange for lifetime benefits.

Similarly, if you have a permanent mental impairment of 30% or more, then you can also apply to be accepted as a ‘seriously injured worker’ with lifetime benefits.

If an injury is caused by a negligent third party you may also have a common law damages claim, separate to your workers compensation claim.
